Please read and understand these conditions prior to bidding on any horse in our auction.

Conditions of Sale

1.     All horses offered at auction are offered in accordance with the laws of the State of Kentucky and the laws of the State of Kentucky shall govern all transactions related to this auction. A halter and lead must be provided and left with each horse sold per Kentucky law.

2.     This sale is an on-premise and live online auction sale from the WKU L.D. Brown Ag Expo Center in Bowling Green, Kentucky (click the link in the WKU name or use the http://www.wku.edu/expo/sales_arena.php to see the facility). This facility has a total of 320 permanent theatre-style seats, each with fold down desktops.  It is arranged in an amphitheater fashion.  This space includes a speaker/auction box, demonstration area, sound system, combination dry erase board/video projection area, and is climate-controlled.  The holding area is an 84' by 92' concrete floor and will be used as exhibit space and make up area for sale horses to be brought up to the ring.  It is adjacent to the sale arena and includes two heated wash racks and restrooms, with showers and lockers. 3.     Total Consignment fee is $100 per horse plus 10% commission on sale price of horse. To better understand the pricing structure, see the chart below:

4.     All horses must have a current, negative Coggins and health paper. If the horse is coming from outside Kentucky, the current, negative Coggins within the year and a 30 day health paper is needed to enter the state.

5.     Horse may arrive at sale location after 12 noon on Friday, March 30. Consigners can purchase shavings from Sale Management for $7/bag. Consigners may bring their own shavings, if preferred.

6.     Each horse offered in this sale will be sold "AS IS", with all faults, conditions and defects, if any. Horses sold shall be without warranty, expressed or implied, as to soundness, condition, merchantability, or fitness for any particular purpose.

7.     Every effort has been made to ascertain correct information, and to print the same in the Sale Catalog; however, Sales Management neither assumes nor accepts responsibility for errors, omissions, or misstatements contained in the Sale Catalog. Announcements at the time of auction will take precedence over material contained in the catalog.

8.     The auction sale is "an auction with reserve", that is, each owner shall have the right to establish a reserve, a price under which the horses will not be sold. When a reserved horse is brought into the sale ring, it will be announced that the horse has a reserve. If through the bidding, the reserve is not met, the owner will have the opportunity to accept or reject the bid at that time. If an animal is sold outside the ring, commission is due back to Sales Management before leaving the grounds.

9.     Horses shall be sold to the highest bidder, subject to condition number 8. In the event any dispute arises between or among two or more bidders, the Sale Management shall have the sole authority and right to settle the dispute, as determined in the sole discretion of the sales management and their decision shall be final and binding on all parties. Bids received after the close of the auction are not a basis for dispute. Sales Management reserves the right to reject any and all bids.

10.  Upon the winning bid, risk of loss and responsibility for the horse shall be upon the buyer. But the consigner will provide feed, water and daily care for the horse during the 30 day grace period before pick up or shipment.

11.  Buyer agrees to issue payment through Sales Management immediately via an on-site payment of cash or check or will have completed an approved bidder application for acceptance of PayPal or credit card (paying by credit card or PayPal will incur an additional 3% above winning bid).

12.  Consigner and/or Buyer agree to hold Sale Management and the WKU facility harmless from all losses, costs and expense, having to do with or rising from illness, injury or death of any animal offered or purchased, and any loss or damage to property and injury to persons, including death, caused by consigner, consigner agents, buyer, buyers agents, representatives or employees, or by the animal, following consignment of animal and/or buyers purchase of an animal.

13.  Notwithstanding, delivery of the horse purchased to buyer, Sales Management will retain all registration papers and transfers until payments have been verified, i.e. checks have cleared buyer’s bank, etc. Upon verification of payment, registration papers, along with properly executed transfer of ownership reports, and any other pertinent documents related to the animal purchased shall be prepared and mailed to the buyer.

14.  All purchases shall be in the form of U.S. currency: bank transfer, certified check, traveler’s check, credit card, pay pal or personal check if approved by Sales Management. ALL Online BUYERS AND Online PROSPECTIVE BUYERS MUST ESTABLISH BUYER IDENTIFICATION PRIOR TO SALE.  Credit card purchases will incur a 3% service fee.  Personal checks will require us to hold papers until the checks clear.

15.   Horses will remain at the seller's farm for a period of 30 days while pickup arrangements are made.  After that period, or a period agreed upon by the seller in writing or electronic communication and the buyer, boarding fees will be charged.  These fees will be established by the seller and should be considered prior to bidding on any animal in the sale. Suggest rates would be as follows: Stallions 7.00 per day, Mares 6.00 per day and fillies or colts 5.00 per day.

Example: A horse is consigned from Illinois to the Bowling Green Select Sale. The horse is sold to Buyer #13 from Florida via online live auction. Buyer #13 will contact the consigner in Illinois to arrange for shipment of purchased animal. The pick-up location would be the farm in Illinois with travel costs to Florida.

As the sale date gets closer, it is the intent of Sales Management to confirm and collect any farm or persons who will be in attendance that can haul horses back to their location or can transport horses to buyer locations. Those names and numbers will be published prior to the sale date. It is the responsibility of the buyer to contact those representatives to make prior arrangement in the case an animal is purchased.

16.  Sale Management will accept substitution for consigned animals until February 29th. After that date, if the consigner has not submitted a substitute, that lot will be left blank and consignment fees will be forfeited to Sales Management.
